  1. Enrollment in the Affiliate Program

    1. Application Process

      • To participate, you must complete an application via our affiliate registration form.
      • Locatory.com reserves the right to approve or reject any application at its sole discretion.
      • Applications may be rejected if they are incomplete, misleading, or if your website, content, or promotional methods are deemed inappropriate.

    2. Eligibility

      • You must be at least 18 years old.
      • Participation is prohibited in jurisdictions where affiliate marketing or performance-based advertising is restricted or illegal.

  2. Affiliate Responsibilities

    1. Compliance

      You agree to comply with all applicable laws and regulations, including but not limited to:

      • Advertising standards
      • Data protection and privacy laws (e.g., GDPR, CCPA)
      • Anti-spam and unsolicited communication regulations

    2. Prohibited Activities

      • Engage in misleading, deceptive, or fraudulent marketing practices
      • Use unauthorized couponing, cash-back, or incentive schemes
      • Bid on Locatory.com brand terms or variations in paid search campaigns without explicit approval
      • Use cookie stuffing, cloaking, or any technology that manipulates tracking
      • Publish content that is offensive, harmful, or illegal

    3. Affiliate Content

      • Affiliates are solely responsible for the accuracy and appropriateness of their promotional materials.
      • You may use approved banners, links, and creatives provided by Locatory.com.

  3. Tracking and Attribution

    • RedTrack.com will be used as the official tracking platform for clicks, conversions, and commissions.
    • Tracking is based on cookies and/or other tracking technologies. Locatory.com is not responsible for conversions that are not properly tracked due to ad blockers, browser settings, or user interference.
    • In case of discrepancies between Affiliate’s data and RedTrack’s data, RedTrack’s data shall prevail.

  4. Commissions and Payments

    1. Commission Structure

      • Affiliates will earn a fixed commission of $200 (USD) for each valid lead that successfully converts into a sale, as determined by Locatory.com.

    2. Payment Terms

      • Payments will be issued no later than thirty (30) days from the date the conversion was achieved.
      • Payments will be made via Bank Transfer or other approved methods.
      • Affiliates are responsible for ensuring accurate and up-to-date payment details are provided.

    3. Invalid Conversions

      • Locatory.com reserves the right to withhold or reverse commissions for:
        • Fraudulent, duplicate, or incomplete leads
        • Conversions that are cancelled or refunded
        • Any activity in violation of this Agreement

  5. Intellectual Property

    • Affiliates are granted a limited, non-exclusive, revocable license to use Locatory.com’s trademarks, logos, and creatives solely for the purpose of promoting Locatory.com.
    • You may not modify or misrepresent Locatory.com branding.
    • All rights, titles, and interests remain with Locatory.com.

  6. Term and Termination

    • This Agreement begins upon acceptance of your application and continues until terminated.
    • Either party may terminate this Agreement at any time, with or without cause, by providing written notice.
    • Upon termination, you must immediately remove all Locatory.com links, banners, and materials.

  7. Confidentiality

    • Affiliates may gain access to confidential information, including but not limited to business practices, customer data, and performance reports.
    • You agree not to disclose or misuse any confidential information.

  8. Limitation of Liability

    • Locatory.com will not be liable for indirect, incidental, or consequential damages arising in connection with this Agreement or the Affiliate Program.
    • Total liability under this Agreement shall not exceed the total commissions paid to the Affiliate in the preceding six (6) months.

  9. Indemnification

    • The Affiliate agrees to indemnify and hold harmless Locatory.com, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
      • Affiliate’s breach of this Agreement
      • Affiliate’s misuse of promotional materials
      • Affiliate’s violation of applicable laws

  10. Modification of Terms

    Locatory.com reserves the right to update or modify these Terms at any time. Affiliates will be notified of significant changes via email or through the Affiliate Program dashboard. Continued participation after modifications constitutes acceptance of the new Terms.
